These Terms of Service govern access to the UnibuyCosplay website and purchases made through it. Please read them with our Privacy Policy, Shipping Information, Returns & Refunds Policy, Payment and Tax information, and any product-specific terms shown before checkout.
1. Acceptance of These Terms
By using the website, creating an account, or submitting an order, you agree to these Terms. If you purchase for an organization, you confirm that you have authority to bind it. You must be legally capable of entering the transaction and must provide accurate information.
2. Website Accounts
You are responsible for maintaining the confidentiality of account credentials and for activity conducted through the account. Notify us promptly if you suspect unauthorized use. We may restrict or close an account used unlawfully, fraudulently, abusively, or in a way that threatens the website or other users.
3. Product Information
We take reasonable care to describe products, options, materials, package contents, prices, and estimated processing times. Colors can vary by display, batches and handmade construction can vary slightly, and photographs may include styling items not sold with the product. The product page and selected order options determine what is included.
4. Orders and Contract Formation
Submitting an order is an offer to purchase. An automated acknowledgement only confirms that we received the request. A binding sales contract is formed when we send dispatch confirmation or another express acceptance notice. We may reject or cancel an order before acceptance because of stock, payment, shipping restrictions, suspected fraud, inaccurate information, or a material product or pricing error. If payment has already been collected for a cancelled order, the relevant amount will be refunded.
5. Prices and Payment
Prices and available payment methods are those shown at checkout. Shipping, discounts, taxes, and other charges are shown before order submission where they can be calculated by us. Destination import charges may be collected separately by customs, the carrier, or another authority. Payment may be subject to authorization, verification, and provider terms.
6. Custom and Made-to-Order Products
Customers must submit complete and accurate measurements, personalization, and option details. Production may begin after order confirmation, and changes or cancellation may then be unavailable or subject to the work and materials already committed. Custom sizing is based on supplied measurements and does not guarantee the same fit as an in-person tailoring service.
7. Shipping, Risk, and Delivery
Processing and transit dates are estimates. Customers must provide a complete delivery address and cooperate with customs or the carrier where required. Risk of loss passes as provided by applicable law. Our Shipping Information page explains tracking, delays, failed delivery, destination charges, and carrier enquiries.
8. Returns, Refunds, and Cancellations
Return eligibility, condition requirements, exclusions, damaged products, refund timing, and cancellation limits are set out in our Returns & Refunds Policy. Nothing in these Terms excludes mandatory rights available under applicable consumer law.
9. Intellectual Property
The website software, layout, original text, branding, logos, photographs owned by us, and other original materials are protected by applicable intellectual-property laws. Character names, third-party trademarks, and other referenced intellectual property remain the property of their respective owners. No license is granted except the limited right to use the website for personal shopping and account management.
10. Prohibited Use
- Do not use the website for unlawful, fraudulent, abusive, or misleading activity.
- Do not interfere with security, scrape restricted data, introduce malicious code, overload services, or attempt unauthorized access.
- Do not submit false reviews, impersonate another person, infringe rights, or use payment methods without authorization.
- Do not reproduce or commercially exploit protected website content without permission.
11. Reviews and Customer Content
If you submit a review, photograph, or other content, you confirm that you have the necessary rights and that it is accurate, lawful, and not misleading. You grant us a non-exclusive, worldwide, royalty-free right to host, display, format, and use that content for the website and related promotion, subject to any separate permission request and our Privacy Policy. We may remove unlawful, irrelevant, abusive, or deceptive content.
12. Third-Party Services and Links
Payment, delivery, social-media, and other third-party services operate under their own terms and policies. Links are provided for convenience and do not make us responsible for third-party content or availability, except where responsibility cannot lawfully be excluded.
13. Warranties and Liability
We do not guarantee uninterrupted website access or delivery before a customer event date. To the fullest extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed. Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability or mandatory right that cannot legally be limited or excluded.
14. Indemnity
You are responsible for loss reasonably arising from your unlawful use of the website, infringement of third-party rights, or deliberate breach of these Terms. This clause does not apply where the loss was caused by our breach or where it would be unfair or unenforceable under applicable law.
15. Changes, Severability, and Waiver
We may update these Terms for future use of the website. The version accepted with an order continues to govern that order unless a change is required by law or agreed with you. If a provision is unenforceable, the remaining provisions continue to apply. Delay in enforcing a right is not a waiver.
16. Governing Law
These Terms and non-contractual disputes are governed by the laws of Hong Kong, without depriving a consumer of mandatory protections that apply in the place of habitual residence. The courts of Hong Kong have non-exclusive jurisdiction, subject to any mandatory forum rights.
